Terms of Service
By creating an account or using Fishician®, you agree to these Terms of Service, the Privacy Policy, and the Community Guidelines. If you do not agree, do not use the service.
1. The service
Fishician provides aquarium management tools, reference information, AI-assisted suggestions, community features, and links to third-party retailers. The service is provided on an "as is" and "as available" basis and may change, be interrupted, or be discontinued at any time.
2. Eligibility and accounts
- You must be at least 13 years old to create an account.
- You are responsible for your account credentials and all activity under your account. Enable two-factor authentication for stronger protection.
- Provide accurate information and keep your email current so we can reach you about security or policy matters.
3. Acceptable use
You agree not to: break the law; infringe others' rights; upload malicious code; scrape, overload, or disrupt the service; attempt to access other users' data; circumvent security or rate limits; resell the service; or post content prohibited by the Community Guidelines.
4. Your content
You keep ownership of content you post. You grant Fishician a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, transcode, display, distribute within the service, promote the service with, moderate, back up, and otherwise operate your content. You are responsible for having the rights to anything you upload. We may remove content or restrict accounts that violate these terms, and we respond to copyright notices under our DMCA Policy.
5. Aquarium information disclaimer — not veterinary advice
Fishician provides general aquarium information and AI-assisted suggestions for hobbyist education only. It is not veterinary medicine, and no output creates a veterinarian–client–patient relationship. AI can be wrong. Species data, dosing calculators, compatibility scores, and health analyses are estimates that may not fit your animals, water, or equipment. Always verify dosages against product labels, and consult a qualified aquatic veterinarian or experienced professional for sick, injured, or valuable animals. You remain fully responsible for the welfare of your animals and for decisions you make.
6. Purchases and third-party links
Fishician links to third-party retailers, including through affiliate referral links (see the Advertising & Affiliate Disclosure). We are not a party to those transactions and are not responsible for third-party sites, prices, availability, or products. Product mentions are informational, not endorsements or guarantees.
Fishician subscriptions
The Free plan includes two actively managed tanks. Plus includes five actively managed tanks for USD $4.99 per month or $39.99 per year. Max includes unlimited actively managed tanks for USD $9.99 per month or $79.99 per year. Core care records, guides, tools, Community, and baseline Finn access are included on every plan. Normal storage, request, and AI usage protections still apply; unlimited tanks does not mean unlimited AI processing.
Web payments are processed through Stripe-hosted checkout. Manual renewal is the default: a purchase covers the paid period shown at checkout and does not authorize another automatic charge. Automatic renewal applies only if you explicitly select it and confirm the recurring price and interval, including any applicable tax. You can turn it off in Settings → Plan & Billing without contacting support. Turning it off keeps your remaining purchased access and stops future renewal payments. You can also renew manually when ready and control your billing reminders in that screen.
An upgrade credits eligible unused paid time against the higher plan's cost for the remainder of the same paid period. The credit and amount due are shown before you confirm, and the upgrade keeps the original end date. Upgrade credit is a price adjustment, not a cash refund. A change to a lower plan takes effect after retained paid access ends unless an approved refund ends the affected paid access earlier.
When your plan has a lower tank limit, you choose which saved tanks remain active for new care records, water tests and management. Your other tanks become historical and read-only; their saved details and history remain available for viewing. A plan change does not delete them. The initial choice is free. After that, one replacement is available immediately, then one per rolling 30 days across your account; you can schedule the next replacement in advance. Higher plans do not reset this allowance, and an administrator may approve an exception. Your own deletion requests remain separate from plan changes.
Complimentary access may have an expiration or continue until an administrator ends it. Subscription payments are paused while the grant is active, eligible unpaid subscription invoices are voided, and remaining verified paid time is protected. Payments already collected are not automatically refunded when a grant is made. Ending complimentary access does not authorize a new automatic-renewal mandate.
Cancellation normally retains your remaining paid access rather than automatically issuing a partial cash refund. You can request payment help or a refund in Plan & Billing, or contact support@fishician.app, including for duplicate charges, billing errors or other circumstances that warrant review. A request is not confirmation that a refund was approved or delivered. Approved refunds are sent to the original payment method; bank processing may take additional time. These terms do not limit any cancellation or refund rights provided by applicable law.
7. AI features
AI features are rate-limited and provided for convenience. Outputs may be inaccurate, incomplete, or unsuitable for your situation, and are not professional advice (see Section 5). Do not submit content you lack rights to, or sensitive personal information, to AI features.
8. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FISHICIAN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL NEVER BE LOST — KEEP YOUR OWN RECORDS OF CRITICAL INFORMATION.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FISHICIAN AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF ANIMALS, DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
10. Indemnity
You agree to indemnify and hold Fishician harmless from claims arising out of your content, your use of the service, or your violation of these terms or applicable law.
11. Termination
You may delete your account at any time in Settings. We may suspend or terminate accounts that violate these terms, create risk for others, or as required by law. Sections that by their nature should survive (5, 8–10, 12) survive termination.
12. Governing law and disputes
These terms are governed by the laws of the United States and the state of the operator's residence, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction unless applicable consumer law gives you additional rights.
13. Changes
We may update these terms; material changes will be announced in the app. Continued use after changes take effect constitutes acceptance. Contact: support@fishician.app.
